Green Book Travel, LLC. Travel Agreement  

 

The following terms and conditions set forth the travel agreement under which you and Green Book Travel, LLC., (tour operator) a Arizona company, hereby mutually agree to be bound.  By purchasing a trip, experience, activity, event or tour you are agreeing to the following policies and incorporates any terms and or provisions as stated on the trip sign up pages and confirmed at booking. The Terms and Conditions in this document, hereafter referred to as "Travel Agreement";  is between "Green Book Travel"; hereafter referred to as; Green Book Travel, LLC; and the named traveler in Agreement, hereafter referred to as "Traveler/Participant/Client".

RESPONSIBILITY

Green Book Travel LLC will provide trips, experiences, activities, events and tours as outlined in it's catalog and on it's website (www.greenbooktravel.com ) or booking and payment platform wetravel (each “TRIP, EXPERIENCE, ACTIVITY, EVENT OR TOURS”) may contract qualified professional tour operators or independent contractors to organize and administer such services. We reserve the right to engage other travel agents, professional organizers,  arrangers,  independent contractor or other helpers having them make arrangements in whole, or in part on our behalf, for the execution of the Package Trip Contracts.

 

Any such designated tour operator, it's parent, subsidiaries, and assigns, and their respective employees, affiliates, officers, directors, successors, representatives, agents and assigns (collectively “Tour Operator”), in turn, acts only as an agent for any transportation carrier, hotel, ground operator, or other suppliers of services connected with specific TRIP, EXPERIENCE, ACTIVITY, EVENT OR TOURS (“Other Providers”), and are solely responsible and liable for providing their respective services.

Green Book Travel, LLC, its subsidiaries, and assigns, and their respective employees, affiliates, officers, directors, successors, representatives, agents and assigns (collectively “GREEN BOOK TRAVEL”) and the Tour Operator will not be held liable for (A) any damage to, or loss of, property or injury to, or death of, persons occasioned directly or indirectly by an act or omission of any Other Provider, including but not limited to any defect in any aircraft, watercraft, or vehicle operated or provided by such Other Provider; and (B) any loss or damage due to delay, cancellation, or disruption in any manner caused by the laws, regulations, acts or failures to act, demands, orders, or interpositions of any government or any subdivision or agent thereof, or by acts of God, strikes, fire, flood, war, rebellion, terrorism, insurrection, sickness, quarantine, epidemics, pandemics, theft, or any other cause(s) beyond their control. The participant waives any claim against Green Book Travel, LLC and/or the Tour Operator for any such loss, damage, injury, or death.

The participant tickets in use with other providers will constitute the sole contract between the providers and the client;  Green Book Travel, LLC is not responsible for any act, omission, or event during the time the participants is engaged for services. Traveler agrees to release, indemnify, and hold harmless Green Book Travel, LLC , its officers, directors, employees, contractors, vendors, travel guides, assignees, transferees, agents, and any other third parties acting on  behalf of  Green Book Travel, LLC company against any and all expenses, losses, damages, accidents, injuries, claims, or deaths resulting in whole or in part, either directly or indirectly, from any aspect of travel and/or activities facilitated by Green Book Travel, LLC . Traveler further agrees that in no event and under no circumstances shall Green Book Travel, LLC, nor its officers, directors, employees, vendors, guides, contractors, assignees, transferees, agents, and other third parties acting on  Green Book Travel, LLC Company's behalf bear any total or aggregate liability (either jointly or severally) under Agreement that exceeds the amount of total fees paid by Traveler to Company for the particular trip in question. 


ELIGIBILITY: Anyone under the age of 18 on the date of first travel is considered to be a minor. Minors must always be accompanied by an parent or guardian for the entire trip. Some itineraries have minimum age requirements and all trips, experiences and tours are subject to our jurisdiction. All bookings with/for a minor are subject to review and approval by Green Book Travel. If the consent of a parent, guardian or any other person is required by applicable law for any minor to travel, the accompanying adult is responsible for securing all consents, documentation and ensuring that they and the minor(s) meet all legal requirements to travel, to enter into and depart from applicable countries and regions. Green Book Travel will not be responsible for any fees, damages, or losses incurred as a result of any failure to secure necessary consents, permits, and approvals.

Each adult on a booking with a minor or minor(s) is jointly and severally responsible for the behavior, well being, supervision and monitoring of such minor(s), and jointly and severally accepts these Terms for and on behalf of any minor(s) on their booking, including all assumptions of risk and limitations of liability. Green Book Travel/LLC does not provide care services for minors and expressly disclaims any responsibility for chaperoning or controlling any minor(s). AUTHORITY TO DECLINE PASSENGERS OR REMOVE PASSENGERS FROM TRIPS: We reserve the right to accept or reject any Client as a trip participant.

We reserve the right to expel any participant from a tour or disembark a participant from a vessel or convergence if we deem this necessary for the comfort, convenience or safety of the trip, tour or experience of participants, including if your behavior is deemed to cause or be likely to cause danger, distress or annoyance to other participants or if we reasonably determine your condition would adversely affect your health, safety or enjoyment or that of other participants.  Green Book Travel, LLC has the right to expel you from a trip, tour, event, activity and or excursion if your are found to be in violation of the travel agreement including hosting unpaid  or unofficial registered participants during any trips, events, activities, excursions and experience, up to and including lodging accommodations. If we remove you from a trip, event, activity, tour or experience in progress, you will not be entitled to any refund, payment, compensation or credit of any kind for unused or missed services or costs incurred resulting from the termination of the travel arrangements and you will be responsible for all of your travel costs and arrangements including your return back home.

By registering for an trip, tour and/or experience, the participant certifies that they do not have any mental, physical, or other condition or disability that would create a hazard for themselves or other participants. Green Book Travel, LLC and the tour operator(s) reserve the right in their sole discretion to accept, decline to accept, or remove any participant on an trip, tour or experience and the tour operator reserve the right, without penalty, to make changes in the published itinerary whenever, in their judgment, conditions warrant or if they deem it necessary for the comfort, convenience, or safety of the participants.  Green Book Travel, LLC reserves the right to request further information or professional medical opinions where necessary, as determined in it's discretion, for your safety or the safe operation of a tour, event, experience or activity. Green Book Travel, LLC reserves the right to deny participants permission to travel or participate in any aspect of a Tour at any time and at your own risk and expense where the Tour Operator determines that your physical or mental condition renders you unfit for travel or you represent a danger to yourself or others. Neither Green Book Travel LLC, nor Other providers will be liable for any air carrier's cancellation penalty or change fees incurred by the purchase of a nonrefundable ticket to or from the participant's departure or return city. Baggage and personal effects are at all times the sole responsibility of the participant.

DOCUMENTATION: Participants are responsible for obtaining any all documents and credentials required for their travel such as a valid passport, visas, vaccination certificates, travel insurance, medical and any other documents.  Traveler understands that all required credentials are the sole responsibility of the traveler from expense to determining whether Traveler needs a visa or any other documents required for travel, the applicable type of visa, and ensuring that credentials are applied for, obtained, and received timely for travel. Failure to obtain documents does not negate the terms and conditions of the Travel Agreement, and any extra costs incurred for rerouting due to travel without the necessary documents will be the participant’s sole responsibility.

US. citizens traveling to any destination outside of the United States will be required to present a valid U.S. passport. Passports must be valid for 6 months past the return date. Some countries require a visa for transit or entry. Passengers are responsible to ensure that they have all the proper documents for entry. All names on documents must match the legal name on your photo I.D., and travel document information must match tickets. Please check the State Department website at https://travel.state.gov for further information. Immunizations and visas may also be required. Failure to comply with these regulations may result in denied boarding, denied entry, and/or government imposed fines. If you are a citizen of another country, there may be additional requirements.

 

Non-U.S. citizens should contact the appropriate consular office for entry requirements pertaining to their trip, as we are not responsible for providing you with this information or documentation. It is the participant’s sole responsibility to obtain and have available when necessary the appropriate valid travel documents. All travelers are advised to check with the appropriate government authority to determine the necessary documents. You may be refused boarding, entry, disembarking without liability for refund, payment, compensation, or credit of any kind if you do not have proper documentation, and you will be subject to any fine or other costs incurred that which results from improper documentation or noncompliance with applicable regulations. Check with the nearest consulate or embassy of the destination you are traveling to and find out the entry requirements for non-U.S. citizens

 

REQUIREMENTS FOR TRAVEL INSURANCE:  Travel insurance is required for all Clients to travel with Green Book Travel, LLC. During travel, injuries may incur large sums of treatment costs or transportation costs. Accidents may also result in claims for damages and compensations in amounts which are difficult to collect from the offender. In order to secure oneself against such cases, we require that you take out a personal travel insurance policy of a sufficient amount to cover medical.  

 

Please note that a US medical insurance policy cannot be accepted as they do not cover #3 below. Therefore a travel medical policy will ensure if you have an accident on the trip we can get you coverage and home.  You will need to send your “Proof of Coverage” document to us 30 days prior to your trip.

 

Your policy must include the following coverage at a minimum. 
(1) Emergency medical insurance abroad for minimum of $25,000 USD
(2) Emergency medical transportation for minimum of $100,000 USD
(3) Repatriation of your body should you perish

Participants may use any insurance provider they wish however your policy must include coverage for the 3 areas listed above including contact information for assistance should you get injured.  For the best coverage on your trip, we recommend you purchase a comprehensive insurance policy that includes a "Cancel Anytime/Cancel any reason " option in case you need to cancel your non-refundable trip and seek additional protection for your investment. It is the travelers responsibility to thoroughly review the terms and conditions of the travel insurance policy you purchase for understanding of protection based on the policy terms. In the event that Traveler seeks to file a claim, the traveler must contact the company that issued the policy.

TRAVEL MEDICAL AUTHORIZATION AND COVERAGE: In the event the participant becomes sufficiently incapacitated as to be unable to direct his or her own care, there is no one on the trip who can direct participant’s care, and Green Book Travel is unable or does not have time to contact participant’s emergency contact, the participant, by registering and paying a deposit for an trip, experience, event or tour, authorizes any medical treatment deemed necessary in the event of any injury or illness while participating in the activity including, but not limited to, X-ray, examination, anesthetic, medical or surgical diagnosis, or treatment and hospital care which is deemed advisable by, and is to be rendered under the general or specific supervision of, any physician and/or surgeon deemed competent to render the necessary care. In addition, the participant certifies that they have insurance or financial means that which will cover personal accidents, medical expenses, medical evacuation, air ambulance, loss of effects, repatriation costs and all other expenses which might arise as a result of loss, damage, injury, delay or inconvenience occurring to the participant, or that in the absence of this medical insurance coverage, the participant agrees to pay all costs of rescue and/or medical services as may be incurred on the participant’s behalf.  Green Book Travel, LLC is not responsible for any medical fees for participants.

MEDICAL ISSUES AND SPECIAL NEEDS: Green Book Travel, LLC reasonably accommodates travelers with disabilities on all of its trips, but not all trips may be suitable for all travelers. 

a) You are encouraged to report any disability requiring special attention to us at the time the reservation is made, including requiring the use of special equipment. We will make reasonable efforts to accommodate the special needs of tour and cruise participants. Such participants, however, should be aware that the Americans with Disabilities Act is inapplicable outside of the United States and facilities outside the United States for disabled individuals are limited.

b) Most of our trips are not wheelchair or motorized scooter accessible, as wheelchair or motorized scooter assistance or accessibility in international destinations cannot be guaranteed. If your trip is wheelchair-accessible and you require a wheelchair, you must provide your own small, collapsible wheelchair. On most international trips, we cannot accommodate women past their sixth month of pregnancy and cannot accommodate service animals.

c) If you are unable to travel without assistance, you must be accompanied by an able companion - per person cost still applicable. It is strongly recommended that participants requiring assistance be accompanied by a companion who is capable of and is completely responsible for providing the assistance. Neither Company nor its personnel, nor its suppliers, may physically lift or assist passengers into transportation vehicles. If a traveler thinks he or she might need assistance during a trip, he or she should call us to determine what assistance might reasonably be given. Green Book Travel, LLC. cannot provide special individual assistance to passengers with special needs for walking, dining or other routine activities or personal services.

d) If you have a condition that requires special equipment or treatment, you must bring and be responsible for all necessary items related to your condition.

e) If you have a condition as contemplated herein, you travel at your own risk. Green Book Travel, LLC  is not liable for any injuries or damages you may suffer relating to such a condition, including without limitation loss of special equipment, lack of assistance with or accommodation of special needs, and unavailability of medical assistance or treatment.

 

PHYSICAL FITNESS & SAFETY: Traveler agrees that their safety is primarily their own responsibility. By traveling with Green Book Travel, LLC participants agree to make sure that they know how to safely participate in activities, and agree to observe all rules and practices that may be employed to minimize the risk of injury. Travelers agrees to stop and seek assistance if they do not believe they can safely continue, to limit their participation to reflect their personal fitness level, and to refrain from any and all actions that would pose a hazard to themselves or others.  Participants understands that as with any physical activities, they should check with their doctor prior to engaging in such activities to verify if they are medically able to participate in any activities. By booking travel with Green Book Travel, LLC, participant acknowledges that they have checked with their doctor and been cleared for any activities that they shall participate in, and that Green Book Travel, LLC Company bears no liability for any activity or outcome that may adversely affect the health or wellbeing of Traveler. 

Walking and climbing stairs are required in many hotels and airports to board an aircraft and for many excursions. If the participant requires a slower pace, extra assistance, or the use of a cane or walking stick, arrangements may be made for private touring at each destination, if necessary, at the discretion of our staff. Depending upon the nature of the arrangements, extra costs for such arrangements may be the responsibility of the participant.

Green Book Travel, LLC assumes no responsibility, liability, or expense for Traveler's inability to travel or participate in any activity or event  due to inability.  Green Book Travel, LLC encourages participants to consult a doctor for specific medical advice about any activities or destinations. 


Special conditions
1. Clients who require special attention from Green Book Travel, LLC. during the tour for reason of chronic disease, general ill-health, pregnancy or physical handicap, shall advise Green Book Travel LLC. of this when applying for the tour. Green Book Travel LLC. shall comply with such requests to the extent deemed feasible and reasonable. And if Green Book Travel LLC. take a special arrangement in compliance with the client’s request, the client shall be responsible for incurred expenses related with the request. Green Book Travel LLC. may require clients to present a medical certificate. We may refuse a client’s application if conditions at travel destinations and facilities are such that safe, smooth tour operation cannot be guaranteed, or require the client to be accompanied by an escort. In some cases, Green Book Travel LLC. shall change a part of the itinerary or recommend the client to join another tour with the minimum extra charge or refuse his/her participation on the tour. Notification concerning acceptance or rejection of client booking shall be made by Green Book Travel, LLC. within two week after the reservation is submitted or provided via notice of traveler.
2. If Green Book Travel, LLC. determines that the client needs medical diagnosis or treatment by a physician owing to illness, functional disease or other reasons during the tour, Green Book Travel, LLC. shall take measures necessary to ensure smooth operation of the tour. All costs resulting from such measures are the client’s responsibility.
3. Independent activities for reasons of the client’s own choosing shall not be arranged by Green Book Travel LLC. during the tour. However, Green Book Travel, LLC. may, depending on the tour course, arrange such activities under separate conditions or provide recommendations.
4. Green Book Travel, LLC. may refuse client participation if it determines that he or she threatens to embarrass, inconvenience or interfere with the collective activities of other tour participants.
5. Green Book Travel, LLC. may also refuse client participation for the tour/trip operational reasons.

BASIS OF PRICING: All prices for trip, tours and experiences are (i) per person based. For Accommodations and lodging Double occupancy, Single occupancy, single supplement, triple occupancy rates are published(ii) quoted in U.S. dollars, (iii) estimates based on tariffs, currency values, airfares and third-party charges, and (iv) subject to change prior to booking. The current price relevant to the trip or experience will be provided to the Participant at the time of booking. After booking, if it is necessary to levy an additional surcharge, Green Book Travel reserves the right to do so, and notification will be given at the time of final invoicing and prior to departure. Please see trip, experience and tour cost in the destination catalog for your per-person booking requirements and rates. Arriving late or leaving a trip or experience in progress, for any reason whatsoever, will not result in a refund or credit, and no refunds will be made for any unused portions of a trip or experience.

 

SINGLE TRAVELERS: Most trips offer a limited number of single rooms, subject to availability and hotel space. Please see individual trip rate charts for the applicable Single Supplement costs. Roommate matching: If you reserve a trip where sharing is possible and you would like to share a double occupancy room with another single traveler of the same gender, we will attempt to match you with a roommate. The participants will be notified if a suitable roommate is not available, in which case the single rate will be charged.

YOUR TRIP PACKAGE: The following may be components included on the trip package that you booked. Please note that the items included in your trip fare are only those that are specified on the booking itinerary. In principle, Green Book Travel, LLC. will not make refunds for the below fares even if clients choose not to use the relevant services included in the package.


Lodging

Private or shared room configurations at the lodging specified in the booking itinerary. A client traveling alone has an option to book a single room for extra charges. Costs are as shown in the respective price outline in each trip booking itinerary.

 

Meals

Only the meals specified in each itinerary are covered

 

Sightseeing, Excursions & Events

By sedan, van, taxi, motor coach , walking and/or sightseeing boat on a seat-sharing basis to the destination plus admission fees to temples, shrines, museums, activities, events etc. mentioned in each itinerary. 

 

Transfers

By motor coach,  sedan, van, taxi, local mode of transportation or ride-share vehicle may be used  on a seat-sharing basis.   Vehicle type is decided based on the group size

 

Gratuities

Gratuities to hotel workers, porters, chauffeurs, wait and service staff

 

Tax

The Consumption Tax or any entry or exit tax fees/levies

 

Airlines

For trips that include flights. Economy-class seats for tours including domestic flights and/or transfers

Swag

Gifts that are provided to the participant as a gift by Green Book Travel, LLC

 

NOT INCLUDED IN THE FARE:

Charges and expenses other than those specified in the preceding Article, such as:
1. Laundry, telephone, additional meals and drinks, and any other expenses of personal nature.
2. Airport departure taxes
3. Baggage fees
4. Medical expenses for injuries and/or illness
5. Traveling and accommodation costs between arrival/departure ( other than what's included) and the start and end points of the itinerary (pre and post trip plans unless organized by Green Book Travel, LLC and paid by Participant.

 

Additional Fares
The additional fares are required for following arrangements
1. Additional charges for “Upgrade Plans” to upgraded hotels or class of room.
2. Additional charges for changing from a “Plan Without meals” to a “Plan with Meals”
3. Additional charges for “Hotel Extension Plan or Excursion Extensions” to extend the staying period
4. Surcharges to upgrade airline classes
5. Other additional charges as specified in booking material and other material.

6. Additional charges or upgrades for tours, excursions, optional tours, experiences, events and activities not provided in the package.

OPTIONAL TOURS/ ADDITIONAL FARES: refers to any activity, transportation, meal, product or service not expressly included in the Trip itinerary or price of the Trip and/or which does not form part of the Tour. You agree that any assistance given by the Tour Operator’s representative(s) in arranging, selecting, or booking, any Optional Extras is purely at your request and the Tour Operator makes no warranties and expressly disclaims any liability whatsoever arising from participation in Optional Extras or Additional Fare bookings or any information provided by any representative of the Tour Operator regarding any Optional Extras. You release the Tour Operator from all claims and causes of action arising from any damages, loss of enjoyment, inconvenience, or injuries related to or arising from participation in or booking of Optional Extras, tours and/or fares. Any liability for loss, damages, death, personal injury, illness, emotional distress, mental suffering or psychological injury or loss of or damage to property associated with Optional Extras or exclusions of the main trip, experience or your is the sole responsibility of the third party providing that service or activity.

PAYMENT PLANS & LATE FEES:  You are required to make minimum monthly payments on the 1st or 15th  (date as noted on your booking) of every month based on your trip balance divided by the payment period, which ends 30 days prior to the trip date. Our low payment plans are based on our vendor payments and we require on time payment from clients in order to provide installment payment plans. There is a three day grace period until the 3rd or 18th to make your payment.  A late fee for interest for the amount of $25 will be issued if you miss your monthly payment after the three day grace period.

REFUND POLICY:  Green Book Travel does not issue refunds. Trip deposits, payments and add-ons are non-refundable.  We recommend a comprehensive travel insurance coverage that includes a "Cancel for Any Reason" option to cover your non-reimbursable costs.  


MISSED PAYMENTS:  After two missed payments, your trip will be cancelled.  You may reinstate your trip within 7 business days of cancellation by bringing your account up to date including late fees for interest for the amount of $25  per monthly billing period -after the three day grace period.


FALSE CLAIMS/REVERSALS: In the event that your place a fraudulent claim to initiate a payment refund after booking a trip, tour or experience with Green Book Travel, you are subject to administrative fee of  499.00 for dispute resolution and 30.00 per hour until solved. Your trip, tour and or experience is non refundable.

CANCELLATION POLICY:  All bookings are fully non-refundable and you must work with your travel insurance provider to obtain reimbursement for your refundable expenses due to your cancellation.  If 
you opt to cancel your trip, you may do so by the following methods:

calling 1-800-966-2101, messaging our staff directly, utilizing the payment gateway Wetravel,  selecting the “contact us” link on our website www.greenbooktravel.com, or by email info@greenbooktravel.com 

If you are a no-show, if you cancel your trip after the departure date, if you do not have a valid passport/visa or are not able to obtain travel documents or requirements, or if you leave a trip already in progress, you will not receive any refund including any unused portion of your trip.

TRANSFER: Green Book does not allow assignment of rights or obligations to another traveler under this travel agreement, or to resell or transfer to persons not associated with a reservation with Green Book Travel for guest rooms, transportation, tours, meeting rooms or another facilities and/or arrangements made under pursuant to this travel agreement.

RESERVATION CHANGES/VALIDITY: Every effort has been made to produce pricing information accurately. Green Book Travel reserves the right to correct promotional or pricing errors at any time. Changes may be necessary as a result of unforeseen circumstances, operational concerns, or concerns for your health, safety, enjoyment or comfort. Any and all changes are at the discretion of the Green Book Travel & it's Tour Operators. a) We reserve the right to modify tour itineraries and substitute hotels and accommodations without liability to Green Book Travel, at its option, may substitute accommodations of an equal or superior class or provide a full refund of the fare actually paid by you, or substitute accommodations of a lower class and provide a refund of the difference, if any, between the booked class and the substitute class but Green Book Travel shall not incur any other liability for failure to provide the reserved berth. Any partial refunds shall be calculated in accordance with the Company’s typical business practices. In certain circumstances, Green Book Travel may change the departure date of your trip or consolidate or cancel any trips that do not reach a minimum level of participation or are overbooked. In this event, you will be offered an alternative departure date or trip. If we are not able to agree upon a suitable alternative, you will be entitled to cancel your reservation and receive a full refund of your trip.

 

ITINERARY CHANGES: The itineraries and experiences presented on the website are subject to modification and change by Green Book Travel. Every reasonable effort will be made to operate as planned, but alterations may still occur after final itineraries are sent.

 

Revision of Contents of Travel Services: Green Book Travel, LLC. may, after conclusion of the Travel Contract, revise its contents and services for any of the following reasons: natural calamity or disaster, weather conditions, civil unrest, suspension of services rendered by transport/accommodation facilities, provision of transportation not based on the original operational plan, governmental orders, or other circumstances beyond Green Book Travel, LLC. control. Green Book Travel, LLC. reserves the right to take necessary measures when safe, smooth trip operations in accordance with the itinerary is deemed impossible, or when there is valid reason to believe that the trip cannot continue. In such cases, must explain in a timely manner its inability to function according to the Travel Contract under the circumstances. However, said explanation may be made after revisions are made when conditions demand.

CANCELLATION OF TRIPS, TOURS OR EXPERIENCES: Green Book Travel reserves the right to cancel any trip, experience or tour because of inadequate enrollment that makes it economically infeasible to operate or because of good-faith concerns with respect to the safety, health, or welfare of the participants. If an trip, tour or experience is cancelled prior to departure, Green Book Travel will provide the participants with a full refund of monies paid; except in the event that the cancellation is due to a significant event* that makes it infeasible to operate.

Delay, cancellation, or disruption in any manner caused by the laws, regulations, acts or failures to act, demands, orders, or interpositions of any government or any subdivision or agent thereof, or by acts of God, strikes, fire, flood, war, rebellion, terrorism, insurrection, political unrest, sickness, quarantine, epidemics, pandemics, theft, or any other cause(s) beyond their control. The participant waives any claim against Green Book Travel, LLC and/or the Tour Operator for any such loss. Claims should be directed to Participants travel insurance carrier.



If a participant elects not to  return to his/her  point of departure, pick up or designation at assigned times, or if the participant elects to leave a trip, tour or excursion in progress of their own volition, the participant acknowledges and agrees that (i) the participant shall be solely responsible for his/her travel plans once he/she departs the trip, tour or excursion (ii) neither Green Book Travel nor the Tour Operator shall have any responsibility for or control over the participant’s safety or activities once he/she departs, and (iii) the participant releases and holds harmless Green Book Travel and the Tour Operator, from any and all costs, liability, loss, damage, injury, or death that may arise out of the participant's decision to not return to his/her original point of departure, pick up or designation. Except as outlined above when Green Book cancels a trip, experience or tour-,Green Book and the Tour Operator have no responsibility for any expenses, including any non-refundable expenses, incurred by the participants in preparing for a cancellation or for any additional arrangements should the participants travel prior to the scheduled group departure date.

CHANGES MADE BY YOU: You are responsible for ensuring that information provided to the Green Book Travel is accurate and up-to-date. Any changes to your name on any bookings is subject to our approval. Any changes to a booking depend on availability and are subject to Green Book Travel approval and these Terms. Any extra costs incurred for making the change will be charged to you along with an administrative fee. Cancellation of any trip, tour, experience. product or service included in a booking will not be considered a change for purposes of this section and will be governed by the applicable cancellation terms. No changes are permitted to any booking within 90 days of departure of the applicable booking.
 

CONDUCT: Green Book Travel, LLC. is not responsible for any accidents that may occur while on any property during events or trips. Green Book Travel does not conduct any forms of background checks on its members and attendees. Please engage at your own risk. Green Book has zero tolerance for misconduct, sexual harassment, assault, and rape and cannot be held responsible for the conduct of members. If you experience any of these scenarios please contact one of the event organizers and they ensure you are out of harm’s way and contact authorities if necessary.

 

PHOTO/VIDEO RELEASE: By booking a trip, experience or tour with Green Book Travel, LLC. we reserve the right to take photographs and video during your travels. You provide the company and its authorized representatives and employees the right to use photographs and video testimony given during trips and event bookings. You authorize Green Book Travel, Inc. its and transferees to copyright, use and publish the same in print and/or electronically.  You fully understand that the video and photography taken will be made available online as well as print where available for such purposes as publicity, illustration, advertising, and Web content.  By traveling, booking a tour or experience with us, you grant to us the absolute and irrevocable right and unrestricted permission to use and publish your image, likeness, name, or biographical information, without compensation, for commercial, advertising, editorial, or any other purpose; and in any manner and medium, whether now known or hereafter devised; and to alter and composite the same without restriction and without your inspection or approval. You hereby release and discharge us from and against any and all claims, liabilities, costs, damages and expenses of any kind arising out of or relating to the use by us of your image likeness, name, or biographical information. If you prefer that your image or likeness not be used, you must advise us in writing, no later than 30 days prior to your departure date.

Photographs and video of your trip may be submitted to us by you or by third parties such as (but not limited to) other travelers, tour guides, crew, or staff members. By submitting such photographs or video, the party making the submission is representing and warranting (a) that the photo is their original work created solely by themselves and does not infringe the intellectual property rights of any party; (b) that they have obtained any and all necessary releases from subjects depicted in said original work; (c) that they grant to us a worldwide, royalty-free, perpetual, transferable, irrevocable, non-exclusive and fully sublicensable right and license to use, in any and all media whether now known or hereafter devised, in perpetuity, anywhere in the world, with the right to make any and all commercial or other uses thereof, including without limitation, reproducing, editing, modifying, adapting, publishing, displaying publicly, creating derivative works from, incorporating into other works or modifying the photo and (d) that they hereby release and discharge us from and against any and all claims, liabilities, costs, damages and expenses of any kind arising out of or relating to the use by us of any photo submitted.

ENTIRE AGREEMENT AND OTHER TERMS: By clicking on the booking link to register for the trip it serves as an electronic signature, you represent that you have read the terms of this agreement in their entirety, fully understand their legal effect, have had the opportunity to consult independent legal counsel and have exercised that right to the extent deemed necessary, and voluntarily enter into this agreement of your own free will and accord, free of any and all duress, coercion, and/or undue influence of any kind. This agreement shall be construed in accordance with, and governed by, the laws of the Arizona, except that this agreement will not be construed in favor of or against either party, but in a manner that is fair to both parties. Any dispute between the parties shall be resolved by binding arbitration, which shall be conducted in the State of Arizona, County of Maricopa.  This agreement contains the entire agreement of the parties. No other agreement, statement, or promise made by the parties shall be binding on the parties. If any provision of this agreement is held in whole or in part to be unenforceable for any reason, the remainder of that provision and of the entire agreement will be severable and remain in effect. This agreement may be modified.
